Purpose and Intended Use:

Forms package designed for horse boarding facilities and stables of all sizes, from individual horse owners taking in one boarder at their home to large, regional boarding barns and stables.

Document Format: 

  • Each agreement is a fillable PDF, allowing the boarding facility to type in information on the computer and print out a completed document. 
  • Each document comes with detailed instructions on how to fill out and understand each portion of the agreement. 
  • Agreement headers include a space for the boarding facility’s name.

The Basics: 

  • Clauses in every Equine Legal Solutions contract.
  • Information identifying the horse(s) to be boarded (breed, gender, age, registration number, etc.).
  • Contact information for boarder, boarder’s farrier, veterinarian and emergency contact.

Boarding Services:

  • Boarding application includes consent to a credit check and asks for detailed information on horse and past boarding facilities. 
  • Boarding stable can check off options for full and partial care, stall cleaning and feeding.
  • Boarding stable can specify type(s) and amount of feed offered. 
  • Suggested additional services that boarding facility may want to offer (can be deleted).
  • Boarding barn has right to move horses to other stalls, paddocks, etc. at its discretion.
  • Stable has option to charge extra fees for additional feed, stallions and foals. 

Liability Releases and Indemnification Agreements:  

  • Boarder assumes all risks of loss or injury to self, personal property and horses.
  • Boarder agrees to be financially responsible for all property damage beyond normal wear and tear. 
  • Boarder agrees to defend boarding stable against lawsuits related to boarder or boarder’s horses.
  • Separate visitor liability releases for youth and adults.
  • Separate youth and adult liability releases for guests who haul in to the boarding facility with their horses.

Payment Terms:

  • When payments are due.
  • What constitutes a late payment.
  • Penalties and interest for late payments.
  • Fees for returned checks and other dishonored payments.
  • Prorated fees for a partial month’s boarding.

Agister's Lien:

Boarding stable has lien on horses in its possession for all unpaid fees.  If boarding stable terminates agreement and horses or other property are still on stable premises after termination, stable can take ownership of horses and property and sell them.

Horse Health Requirements:

  • Initial and ongoing vaccination schedules that boarding stable can fill in with its requirements.
  • Boarding facility can fill in its parasite control requirements (e.g., worming).
  • Boarder is required to obtain farrier care every 6-8 weeks.
  • Boarder is responsible for fulfilling vaccination, farrier and deworming requirements, and if boarder doesn't do it, boarding facility can step in and have it done, bill the boarder.
  • Boarding barn has right to seek emergency veterinary care for boarder's horse and boarder must pay for the care.

Termination:

  • Either party can terminate on 30 days' written notice for any or no reason.
  • Boarding stable can terminate on seven days’ written notice for cause (e.g., boarder not paying, not following barn rules).
  • Boarder can't remove horses until all fees paid in full.
