  • Recipient assumes all responsibility for the horse’s care and expenses immediately upon signing the agreement.
  • Disclaimer of all representations and warranties other than those specifically provided in agreement.
  • Statement that donor recommends recipient get a vet check before agreeing to take the horse.
  • Statement that donor recommends recipient obtain advice from a professional trainer before agreeing to take the horse.
  • Recipient agrees to indemnify donor if donor is sued in connection with the horse and recipient.

Representations about the Horse: 

  • Donor represents to recipient that donor is the sole lawful and registered owner of horse and that there are no liens on the horse.
  • Choice of representations about the horse’s physical condition, with option to give no representation to the recipient.
  • Choice of representations about horse’s vet records, with option to release records to the recipient.
  • Choice of representations about horse’s behavior, with option to give no representation to the recipient.
  • If horse is a mare, choice of representations about her pregnancy status, including option to give no representation to the recipient.
  • Choice of options about delivery of horse’s registration papers (if any).
  • Disclaimer of all other warranties, express or implied.

Tax Deductibility:

  • Option for recipient to inform the donor of the recipient’s tax-exempt status (if any).

Right of First Refusal:

  • Optional provision allowing donor to have a right of first refusal if recipient sells or gives away horse in the future.
