Equine Legal Solutions (ELS) is a leading equine law firm based near Portland, Oregon. Rachel Kosmal McCart, ELS’ founder, is licensed to practice in four states: California, New York, Oregon and Washington. Rachel is also admitted to practice before the U.S. District Court for the District of Oregon and the U.S. District Court for the Central District of California. Rachel also works with attorneys in other states as a consultant and pro hac vice. For all breeds and disciplines, ELS represents clients in litigation, helps resolve equine disputes, drafts customized equine contracts, represents clients in horse industry disciplinary hearings, and incorporates equine businesses.
Equine LitigationELS represents both plaintiffs and defendants in many different types of horse-related lawsuits, ranging from horse sale disputes to equine veterinary malpractice cases. We charge an hourly rate of $575, and for almost all matters, we require a retainer. All retainers are deposited into ELS’ attorney-client trust account, clients are invoiced for all work performed and invoice amounts are deducted from the retainer. Any retainer funds remaining at the end of the matter are promptly refunded to our clients.
ELS offers initial 30-minute telephone consultations on equine legal matters for persons who are residents of California, New York, Washington or Oregon (or persons who have equine legal matters concerning one of those states). Consultations are $225 and can requested on our Consultations page. |
Incorporation and LLC FormationThis service is available only to customers in Washington, Oregon, California and New York. ELS advises its clients in Washington, Oregon, California and New York to incorporate or form a limited liability company for their businesses. To make the process affordable for its clients in these states, ELS offers incorporation or LLC formation for a fixed price of $1,500, plus expenses.
Customized ContractsThis service is available only to customers in Washington, Oregon, California and New York. For clients located in these states with specialized needs, ELS drafts customized contracts tailored to individual situations. We charge an hourly rate of $575. For clients in these states who have purchased one of ELS’ form contracts and later need customization, ELS is always happy to credit the equine forms purchase price toward the customized equine contract.

Attorney Bio
ELS’ founder and owner, Rachel Kosmal McCart, is a graduate of Duke University School of Law and has practiced law for more than 25 years. Rachel is a member in good standing of the Oregon, Washington, California and New York bars, is admitted to practice before the U.S. District Court for the District of Oregon and the U.S. District Court for the Central District of California and is a member of the Federalist Society. Prior to founding Equine Legal Solutions, Rachel was a corporate lawyer at Donovan, Leisure, Newton & Irvine in New York and Cooley Godward, LLP in the San Francisco Bay area. Rachel also served as in-house securities counsel at Silicon Graphics and Intel Corporation.
Rachel grew up on a horse farm in Tipp City, Ohio and competed as a youth rider in nearly every discipline at Appaloosa, Quarter Horse and hunter/jumper shows. To help raise money for their horse show efforts, Rachel and her mother Mary Kosmal bought, retrained and sold horses. As a 10-year member of Miami County Ohio 4-H, Rachel never missed 4-H horse camp, and she had a lot of fun (and learned something, too!) as part of winning horse bowl and judging teams.
Rachel is a member in good standing of the United States Eventing Association, and AQHA Professional Horsemen. She currently owns three horses. As an adult amateur, Rachel earned numerous open and amateur American Paint Horse Association (APHA) points in almost every event as well as many year-end APHA regional awards in a wide variety of different events. In 2012, Rachel switched to three-day eventing.
Rachel keeps her horses at her home in Oregon, which is shared by Stewart, a Peterbald cat; Norbert and Olivia, Cornish Rex cats; Minnie, the barn’s feline rodent patrol; Calvin, a retired racing greyhound; and livestock guardian dogs Bert and Ernie. She also has a flock of assorted chickens that she raises for meat and eggs. Rachel grows a large organic garden, supplemented by horse manure, that includes more than 20 varieties of heirloom tomatoes. In her spare time, Rachel enjoys designing and making jewelry as Ride the Wind Designs.

Rachel McCart regularly speaks on equine legal topics, and has been a guest lecturer at numerous prominent horse industry gatherings, including the American Quarter Horse Association Convention and the California Horse Expo.
